1. Acceptance of Terms
Welcome to SalesTub. These Terms of Service ("Terms") govern your access to and use of the SalesTub customer relationship management platform, website, and related services (collectively, the "Service") provided by SalesTub Technologies Private Limited ("SalesTub," "we," "us," or "our").
By creating an account, accessing, or using our Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
If you do not agree to these Terms, you may not access or use the Service.
2. Description of Service
SalesTub provides a cloud-based customer relationship management (CRM) platform designed to help businesses manage contacts, leads, deals, sales pipelines, and customer interactions. The Service includes:

- Sales pipeline and deal management
- Activity logging and task management
- Email integration and automation
- Reporting and analytics
- Team collaboration features
- API access for integrations
3. Account Registration
3.1 Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our Service. By using the Service, you represent that you meet these requirements.
3.2 Account Creation
To use the Service, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 Account Security
You agree to notify us immediately of any unauthorized access to or use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
4. Subscription Plans and Billing
4.1 Plans
We offer various subscription plans with different features and pricing. Plan details are available on our pricing page. We reserve the right to modify plans and pricing at any time with reasonable notice.
4.2 Free Trial
We may offer a free trial period for new users. At the end of the trial, you must subscribe to a paid plan to continue using the Service. We may limit features available during the trial.
4.3 Payment Terms
Subscription fees are billed in advance on a monthly or annual basis, depending on your chosen plan. Payments are processed through our authorized payment partners (Razorpay, Stripe, or others). You authorize us to charge your payment method for all fees due.
4.4 Taxes
All fees are exclusive of applicable taxes (including GST). You are responsible for paying all taxes associated with your use of the Service. We will add applicable taxes to your invoice as required by law.
4.5 Price Changes
We may change our prices at any time. Price changes will take effect at the start of the next billing period following notice. If you do not agree to the new prices, you may cancel your subscription before the change takes effect.
5. User Responsibilities
5.1 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Upload or transmit viruses, malware, or harmful code
- Attempt to gain unauthorized access to the Service
- Interfere with or disrupt the Service
- Use the Service to send spam or unsolicited communications
- Impersonate any person or entity
- Collect or harvest user data without authorization
- Use automated systems to access the Service beyond authorized API usage
- Resell or redistribute the Service without authorization

6.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, we may use such feedback without any obligation to you. You assign to us all rights in any feedback you provide.
7. Third-Party Services
The Service may integrate with third-party services (e.g., Gmail, payment gateways). Your use of such services is subject to their respective terms and privacy policies. We are not responsible for the availability, content, or practices of third-party services.
8. Service Availability
8.1 Uptime
We strive to maintain high availability of the Service. We target 99.9% uptime but do not guarantee uninterrupted access. We may perform maintenance that temporarily affects availability.
8.2 Modifications
We may modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes when possible.
9. Termination
9.1 Termination by You
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will not receive a refund for the remaining period, except as provided in our Refund Policy.
9.2 Termination by Us
We may suspend or terminate your account if you violate these Terms or for other reasons with reasonable notice. In cases of serious violations, we may terminate immediately without notice.
9.3 Effect of Termination
Upon termination, your right to use the Service ends. You may export Your Data before termination. We will delete Your Data within 90 days of termination, unless required to retain it by law.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOU USE THE SERVICE AT YOUR OWN RISK.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SALESTUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Indemnification
You agree to indemnify and hold harmless SalesTub, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Dispute Resolution
11.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict of law principles.
11.2 Arbitration
Any dispute arising from these Terms shall be resolved through binding arbitration in Bangalore, India, in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English by a single arbitrator appointed by mutual agreement.
11.3 Jurisdiction
For any disputes not subject to arbitration, you consent to the exclusive jurisdiction of the courts in Bangalore, Karnataka, India.
12. General Provisions
12.1 Entire Agreement
These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SalesTub regarding the Service.
12.2 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce it later.
12.3 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.
12.4 Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms freely.
12.5 Notices
We will send notices to the email address associated with your account. You may send notices to legal@salestub.com.
12.6 Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms.
